User Agreement
This User agreement sets forth the terms and conditions for use and availing of services of SuperbmyTrip.com by the Users. By accessing and using this website by the User, it shall be presumed that the User is in agreement with these terms and conditions. In case User is not accepting or agreeing to the terms and conditions as given in SMT terms & conditions, User Agreement and Privacy Policy then User is requested not to use this website any further.
USERS REPONSIBILITY
By using this Website, User alone will be responsible for maintaining the confidentiality of information of his/her account, Credit/debit cards, CVV, OTP and passwords and not inform details to anyone even to any employee, representatives or agent of Superb My Trip etc. Users shall only be responsible for any misuse of their credit/debit cards whatsoever.. User agree to accept responsibility for all the activities that takes place under or through User’s account. User always represent that he/she is of the age as prescribed by law to be eligible to enter into an agreement which has binding reciprocal legal obligations. Thus, Users are capable, willing, and ready to discharge any liability that User may incur as a result of the use of this Website. User fully understand and agree that User would be financially responsible for using this website, either personally or via those who are using User’s login credentials. Superb My Trip shall not be liable in any way for any loss that Users incurs for sharing the aforesaid details. Users may download and print the materials available on the Website of Superb My Trip for their personal and non-commercial use only. Users should not use any "robot," "spider" or any other automatic device or programs, algorithm or methodologies having similar processes or functionality, or any manual processes to monitor or copy any of the web pages, data or content given on the Website without the prior written permission of Superb My Trip Pvt. Ltd. Users agree that they will not transmit or transfer any web pages, data or content of this Website to any other computer, server, website, or any other medium for use in any commercial enterprise or for mass distribution. SEGMENTATION OF A PROVISION
In case any clause or provision of the Users Agreement is decided to be invalid or cannot be enforced, in that case invalidity shall only be applicable to that particular clause or provision and all other clauses/provisions of the Agreement shall continue to be fully effective and enforceable according to applicable laws.
SECURITY RLATED PRECAUTIONS
The Users need to take necessary precautions to ensure that the programs selected by them for using to access our Website are free from viruses, worms, trojans, malicious codes and other items of destructive nature that could directly or indirectly damage and compromise the working of our Website.
TERMS & CONDIDITION FOR SPECIFIC PRODUCTS AND SERVICES :-
1. Hotels:
While booking a Hotel on our Website, it is advised to carefully read the fact sheet details to ensure that User has understood the amenities available and the same are as per your requirement. The details of the hotel amenities, rooms, facilities given on the Website are provided by the hotels since Superb My Trip act as a facilitator. Superb My Trip updates all these fact sheets and details as and when provided but it is wholly dependent on the respective hotel for timely updation of information. Hotels reserve the right of admission as per prevalent and applicable laws. The principal guest must be an adult and shall carry a photo identity and address proof while checking-in at the hotel. The check-in and check-out timings are according to the policy of concerned hotel. In case of any dispute, the User has to resolve it with the respective Hotel and Superb My Trip shall not be held liable for any miscommunication or lack of any information etc.
2. Airlines Tickets :
Users are given a choice of full fare service and low fare airline options on our website. Low-cost airlines do not have all the services available on board. Hence, Users shall go through the rules and regulations of airlines thoroughly about the fares, class, baggage allowance, refunds, other services etc. Users are advised to choose the airlines very carefully keeping in view the terms & conditions of the airlines as well as their own needs before finalizing and making bookings. Against Users bookings, paper tickets or e-tickets will be provided and both are valid to travel from the airline’s end. Airlines have the right to change the flight timings, change the route or cancel the flight(s) according to particular circumstances prevailing at that time without intimating the Superb My Trip. Superb My Trip has no prerogative or control over the logistical procedures of the airlines. Superb My Trip only act as an intermediary and cannot be held responsible for any flight delay, change of route or its cancellation. Such decisions are taken entirely and solely by the airlines. Users are also advised to carry all the necessary travel documents with them as per concerned country’s rules, like Passport, Visa, Identity proof, air tickets check-in timings etc. In case User is unable to travel due to lack of travel documents Superb My Trip shall not be held responsible for any loss or otherwise.
3. BAGGAGE
Users are recommended to carry their baggage as per concerned airline’s baggage policy since it differs from airline to airline and according to the class a User is travelling. Carrying excess baggage than entitlement would result in extra charges by the airlines as per their policy. However it is always advisable to refer to the up-dated baggage rules of the concerned airlines before travelling. The delay in arrival of baggage or misplacement / loss of baggage by the airlines or passengers will be the sole responsibility of the airline or passengers. In this connection, the passengers have to directly deal with the airline.
4. Rail and Cruises
Users shall refer to the individual rules & regulations applicable to both rail and cruise providers worldwide. These rules will be applicable to Users for each service booked through the Website. Superb My Trip Pvt. Ltd. being a travel and holiday advisor act as a coordinator and do not operate or control any airline, hotel, transport, shipping company etc.. Superb My Trip only select them as service providers and have no control on their operations and logistical procedures. Superb My Trip shall not be held responsible for any lack of service by any independent agency/service provider, e.g., airline, transport company, hotel, rail, cruise or any other concerned service provider.
5. Transfers & Sightseeing
Users have a choice to select a “seat-in-coach” basis sightseeing or private sightseeing tours and transfers. Users shall choose the same carefully with respect to their flight time or train timings. Panoramic tours at any destinations generally do not allow Users to stop at a particular site of attraction. Users are supposed to follow a sightseeing schedule as pre-arranged and advised by the concerned Superb Travel advisor keeping in mind the available time and tour sites to be covered. Entrance fee to attractions sites like amusement parks, adventure sports, monuments, cruise etc. are normally not included in city tours unless specified and this needs to be paid always at the time of entry point of the sightseeing. Users are advised to carefully check all the details, vouchers, itinerary etc.
6. TAVEL INSURANCE
It is strongly recommend that passengers should take adequate Travel insurance cover to secure their health and life while travelling . In order to cover the risk of medical issues and life cover, while on tour, Superb My Trip can identify reputed insurance companies for Travel insurance at the affordable rates. However, it would be the responsibility of the Users to check the suitability, accuracy and terms & conditions of the insurance policies. User may also note that if there are any insurance claims, those shall be referred directly to the insurance company for settlement. Users should ensure that they must carry travel insurance policy documents along with them.
7. PAYMENTS
All online payments made via www.superbmytrip.com site while booking any product or service are secure. Superb My Trip does not store or save the credit card, debit card, or any other payment details of any customer in their database or in any data backup system or retrieval systems. Once Users have finalized and are ready to do bookings/transactions, Users will be transferred to the bank gateway for making online payment. The Users shall not disclose any sensitive details about their credit/debit cards numbers, CVV, OTP etc. to anyone, even to any employee, representatives or agent of Superb My Trip. In case Users disclose any sensitive details about their credit/debit cards, they shall only be responsible for any misuse of their cards whatsoever. Superb My Trip shall not be liable in any way for any loss that Users incurs for sharing the aforesaid details. The User shall be fully responsible for all charges, fees, taxes etc., for use of services as per applicable laws. All the payment by Users should be made to the bank account of Superb My Trip only and not to any private account.. Once the payment made by Credit/Debit card has been cleared by Users bank and the respective gateway and thereafter service has been provided by SuperbMyTrip to the Users, no request for charge-back thereafter will be accepted.
8. Mode of Payment
The payments can be made through WIRE TRANSFER to our bank or via Mail Authorization through CREDIT CARDS or CASH which can be deposited in any of our bank accounts. We accept Master, American Express, and Visa Credit cards. In India the payment can be made in traveller cheques, credit cards or cash. In case of payment made through a credit card, applicable bank charge would be applicable on the amount being paid.
9. REFUND
The refund, if any, is mainly dependant on several factors such as cancellation policies of suppliers like airlines, hoteliers, number of participants, coach operators, etc. The decision on the quantum of refund/No refund is determined by Suppliers as per their respective terms & conditions and shall be deemed to be final. The process of refund, if any, can take at least 45 to 50 working days. No refund will be initiated by Superb My Trip, in case the trip got interrupted due to Force Majeure. Users may note that no refund shall be provided by the Superb My Trip but will be considered by respective suppliers as per their policies. In case any refund is processed, it shall be credited to the same account from which the payment was made.
10. Use of the Website-SuperbmyTrip.com
Superb My Trip Pvt. Ltd. offers a non-transferable license to use this website (SuperbmyTrip.com) in accordance with the terms and conditions specified in the User agreement. This Website shall only be used by the User to make legitimate reservations or purchases and not to take any action which brings burden on its infrastructure as it would be completely undesirable, unreasonable and in violation of the relevant law. The Users should not use this Website for any other purpose, including without limitation, for any false or speculative or fraudulent reservations. The Users are not authorized to make a reservation in the name of a fictitious person. The User agree that he/she will not use any device, software, or demeanour which will interfere or is reasonably expected to interfere with the normal functioning of this Website. The User is not permitted to post or transmit any unlawful, against religious belief, indecent, or any other content which could constitute or encourage a criminal offence or give rise to civil liability or otherwise violative of any applicable laws. Besides, the Users are also totally prohibited from posting or transmitting any information which:-
a) Infringe the rights of others or violate their privacy or publicity rights.
b) Is protected by copyright, trademark, patent or other proprietary rights, unless with the written permission of the owner of such right.
c) It contains a virus or bug or any other harmful item or program.
d) Colluding unlawfully against another person in restraint of trade or competition.
The Users shall be deemed to be solely liable for any damages caused from infringements of copyright, trademark or other proprietary rights or any other harm resulting from the use of this Website by them.
11. WARRANTIES
Superb My Trip specifically disclaims all warranties with respect to this Website or its use by Users thereof – whether implied expressly, or otherwise - including without limitation, all warranties of merchantability and fitness for a particular purpose. Superb My Trip shall not be liable for any loss or damage resulting from the use or misuse of this Website or the information available on this Website.
12. FORCE MAJEURE
In the event of exceptional circumstances which are beyond the control of Superb My Trip or the Service Providers like act of God, terrorist activity, government decisions, insolvency, war etc. due to that Superb My Trip and/or Service Providers are not able to honour the confirmed arrangements, it will make its best efforts to provide similar alternatives to the Users if supported by the respective service providers. The Users agree that Superb My Trip cannot be held responsible for any such Force Majeure circumstances.
13. ARBITRATION
All legal disputes regarding Superb My Trip will be settled under the Indian laws. In case of any dispute of whatsoever nature arising under this agreement, it shall be resolved / settled through a good faith negotiation amongst the parties. In case the dispute is not resolved by negotiations within 30 days, it shall be referred to the arbitration in accordance with the provisions of the Arbitration and Conciliation Act 1996. The location of arbitration shall be Delhi, India. The decision of the arbitration tribunal shall be final and binding upon the parties. In case the dispute require court intervention, the courts in Delhi shall alone have the exclusive jurisdiction.
